As per new AIA provisions, third parties are now permitted to anonymously submit prior art of record that may be relevant to the examination of a patent application that is currently in prosecution. We provide the required concise description of relevance, in the form of a claim chart. The search approach is very similar to an invalidity search.
An infringement search identifies active patents having claim language that your business may infringe upon. You provide us with the features of the product or service you are seeking to clear, and we conduct a search for all relevant references, highlighting pertinent claim language.
A freedom-to-operate search is similar to an infringement search, with the additional layer of examination of expired prior art, which are in the public domain, and are thus free to use.
An invalidity search seeks to invalidate specific claim(s) of an issued patent. This is accomplished by identifying prior art that either alone or in combination reads on the specific claim(s), and was not considered by the Examiner during prosecution. US, foreign, and NPL databases are exhaustively searched. We set ourselves apart from the rest with our extensive NPL resources, as this can provide a wealth of prior art that the USPTO and other patent search firms do not have access to.
Accelerated examination is a program at the USPTO that enables a patent application to reach decision within 12 months. Where we can greatly assist is in the drafting of the Accelerated Examination Support Document (AESD), which comprises a search history, as well as a listing of relevant prior art, and application of the prior art to the claims of your application.
A patentability search seeks to locate prior art relevant to the novelty of an invention. US, foreign, and NPL databases are exhaustively searched. Similar to invalidity searches, we set ourselves apart from the rest with our extensive NPL resources, as this can provide a wealth of prior art that the USPTO and other patent search firms do not have access to.
A truncated version of a full patentability search. This search is ideal for projects with a limited budget. The focus of a knockout patentability search is high-level prior art. This search is not as extensive and exhaustive as a full patentability search, but if there is 102 prior art out there, this search will find those reference(s).
Landscape/State of the Art
A landscape search provides an overall perspective of all prior art in a specific technology field. Since this is a broad search that typically results in a large number of references, we will provide categorization of the state of the art of your invention, so the results will be organized and easy to view as a “landscape.”
